Judge Rita Lin of the Northern District of California granted summary judgment for Anthropic on August 28, vacating Pentagon directives that had barred use of the company's AI technology as unlawful First Amendment retaliation.
The court found the government's own record tied the blacklisting to Anthropic's refusal to allow Claude for lethal autonomous weapons and mass surveillance of Americans and to the company's public criticism of the Pentagon. The ruling also found violations of Fifth Amendment due process and the governing statutory scheme.
